The Vulnerable Children (Requirements for Safety Checks of Children’s Workers) Regulations 2015 came into play on the 1st of July this year. This Regulation has put in place some strict requirements when hiring workers who work with children.
As from 1st of July this year all businesses and organisations that get partial or full funding from any Government body must safety check and risk assess all core workers before they start working. All existing core workers must be safety checked and risk assessed within 3 years of the Regulation coming in.
There is a slightly different implementation timeframe for non-core workers but ultimately they too will need to go through the same safety check and risk assessment as core workers.
Examples of businesses or organisations that need to follow these Regulations include early childcare centres, schools, support services, health services, after school care services, holiday programmes, school bus services, residential disability services and maternity services.
A safety check includes an identify check, work history record, candidate interview, candidate reference check, professional body check (memberships, licences and registrations) and a Police Vet check.
A risk assessment includes a review of all of the information gathered during the Safety Check process making an assessment of the risk the candidate/employee may be to a child/children.
Here are some consequences you need to think about:
- No worker can commence work without a safety check and a risk assessment being completed. There may also be a fine of up to $10,000 with a conviction.
- It is now illegal to hire someone or continue to employ someone who has one of the listed offences in the Regulation. There may be a fine of up to $50,000 with a conviction.
